These Terms & Conditions ("Terms") are a binding agreement between you and Botanelo, a brand of The Nelson M Group LLC ("Botanelo," "we," "us"). They govern your use of botanelo.com and related services, among them email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If you do not agree to them, you should not use the Services.

Botanelo is an information service. We publish general, plain-language data about health and beauty topics, and let visitors opt in to related updates. We never sell products or treatments, make medical claims, give medical advice, diagnose or treat any condition, match people with clinicians, retailers, or service providers, or refer people to providers, and we never share your details with clinicians, retailers, or other partners.

• Decisions about your skin, hair, body, and routine are yours. Reading our content does not obligate you to do anything.
• The clinician, retailer, or brand you deal with, not Botanelo, sets its own products, prices, and advice and is responsible for its own work and decisions.
• Skin, hair, products, and results vary from person to person. We never guarantee that any habit, ingredient, or product will work, cost or save any amount, or turn out any particular way.

You must be at least 18 years old, based in the United States, and able to form a binding contract to use the Services. You may only submit data about yourself, or about another person who has authorized you to do so.

You promise that what you submit is accurate and up to date, and you will update it if anything changes. The mobile number you enter must be one you own or have authority to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

By opting in, you agree that we may reach you by email and, where you check the relevant boxes, by automated text messages as set out in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. The following are prohibited: (a) submitting false or misleading details, or data about someone else without authority; (b) unlawful, fraudulent, or abusive use of the Services; (c) disrupting the Services or attempting unauthorized access; (d) using bots or automation to submit forms; (e) copying, scraping, or reselling our content without permission; and (f) impersonating a person or entity. Breaking these rules may lead us to suspend or end your access.

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, manufacturers, or nonprofit organizations) are run by third parties. We do not endorse any product, brand, or provider and are not responsible for the conduct, content, or results of third parties. Your relationship with a retailer, brand, or health professional is between you and them.

The Services, including the Botanelo name, logo, text, graphics, and design, are owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial uses.

No warranties of any kind, express or implied, apply to the services or content, which are supplied "as is" and "as available." This includes implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We also do not warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered on time or at all.

Botanelo does not offer medical, professional, legal, or financial advice, and makes no representation about any product, ingredient, result, or health outcome.

Where the law permits, Botanelo and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health, beauty, or product decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Because some jurisdictions restrict certain limitations, portions of the above may not apply to you. Nothing here limits liability that cannot lawfully be limited.

If your violation of these Terms, your misuse of the Services, or your submission of a phone number or other data you were not authorized to offer leads to claims, damages, or expenses (including reasonable attorneys' fees), you agree to indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel.

Informal resolution first. Please let us know about any problem first, at [email protected] and give us 30 days to try to resolve it.

Binding arbitration. Small-claims matters and claims for injunctive relief against intellectual-property misuse are excluded. Any other dispute between you and Botanelo or The Nelson M Group LLC that arises out of or relates to these Terms or the Services will be settled by final, binding, individual arbitration run by the American Arbitration Association under its Consumer Arbitration Rules. You choose whether the arbitration takes place in your county of residence or by video or phone. The arbitrator can grant the same individual relief a court could, and any court of competent jurisdiction may enter judgment on the award.

Class-action waiver. You and Botanelo each waive, to the extent the law permits, any right to bring claims as a plaintiff or class member in a class, collective, or representative action; claims may be brought on an individual basis only.

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with the subject "Arbitration Opt-Out", stating your name and mobile number.

Governing law. These Terms are subject to the Federal Arbitration Act and to the law of the state of The Nelson M Group LLC's principal place of business, disregarding conflict-of-law rules. Other than as the arbitration clause supplies, courts of that state, state and federal, have exclusive jurisdiction.

You may stop using the Services at any time, and may opt out of messages by replying STOP. We reserve the right to suspend or terminate access at our discretion, including for violations of these Terms. Disclaimers, limitation of liability, indemnification, disputes, and any other section that by its nature should survive will survive termination.

We can amend these Terms by posting a new version with a new "Last updated" date; if you retain using the Services after the effective date, you accept the amended Terms. We will give legally mandated notice of material updates.

These Terms, the Privacy Policy, and the SMS Terms make up the whole agreement between you and us on this subject. An unenforceable part does not affect the remainder, and our not enforcing a provision is not a waiver of it. You may not assign these Terms without our consent. We may assign them in connection with a merger or sale of the business.
